L\u2019EMPRISONNEMENT N\u2019EST PAS UN JEU D\u2019ENFANT<\/strong><\/p>\n

 <\/p>\n

Une arrestation constitue une exp\u00e9rience angoissante \u00e0 tout \u00e2ge, mais surtout pour les enfants qui en restent traumatis\u00e9s.<\/p>\n

 <\/p>\n

Deux rapports r\u00e9cents r\u00e9alis\u00e9s gr\u00e2ce \u00e0 l\u2019aide financi\u00e8re de l\u2019Union europ\u00e9enne <\/em>et publi\u00e9s par Defence for Children International <\/em>(DCI) et l\u2019organisation isra\u00e9lienne des droits de l\u2019homme Betselem <\/em>(*) d\u00e9crivent en d\u00e9tail comment les mineurs d\u2019\u00e2ge palestiniens sont d\u00e9pourvus de toute protection juridique \u00e9quitable dans le syst\u00e8me juridique militaire isra\u00e9lien.<\/p>\n

 <\/p>\n

Les enfants palestiniens dans les territoires palestiniens occup\u00e9s sont priv\u00e9s de certains droits de l\u2019enfant, tels que le contact avec les parents, l\u2019assistance d\u2019un avocat au cours de l\u2019interrogatoire, le droit de visite et le droit \u00e0 l\u2019enseignement. Ceci apr\u00e8s une arrestation effectu\u00e9e souvent en pleine nuit et accompagn\u00e9e fr\u00e9quemment de violence verbale et physique, o\u00f9 les enfants sont emmen\u00e9s menott\u00e9s et les yeux band\u00e9s. Les accusations sont bas\u00e9es essentiellement sur des pr\u00e9somptions et ne sont pratiquement jamais prouv\u00e9es. Apr\u00e8s des interrogatoires de plusieurs heures et ou des d\u00e9tentions dans une cellule d\u2019isolement, un aveu est arrach\u00e9 par l\u2019intimidation et les menaces.<\/p>\n

 <\/p>\n

Au total 7500 enfants palestiniens dont 975 de moins de 15 ans ont \u00e9t\u00e9 arr\u00eat\u00e9s et trait\u00e9s de cette mani\u00e8re depuis 2000. On estime \u00e0 265 la moyenne mensuelle des mineurs d\u2019\u00e2ge se trouvant en prison.<\/p>\n

 <\/p>\n

Je crois en une proc\u00e9dure \u00e9quitable respectant les droits universels de l\u2019homme <\/em>et en l\u2019occurrence, les droits universels de l\u2019enfant.<\/em><\/p>\n

 <\/p>\n

La p\u00e9tition veut \u00e9galement ouvrir les yeux de la communaut\u00e9 face \u00e0 la discrimination des enfants palestiniens, ainsi qu\u2019\u00e0 la disproportion entre l\u2019accusation et la peine prononc\u00e9e par les tribunaux militaires isra\u00e9liens.<\/p>\n

 <\/p>\n

Je soutiens la campagne de \u2018l\u2019a.s.b.l. Palestina Solidariteit\u2019 et \u00e0 souscrire aux revendications suivantes.<\/p>\n

 <\/p>\n

Aucun enfant ne peut \u00eatre traduit devant des tribunaux militaires intentant des proc\u00e8s malhonn\u00eates et ne r\u00e9pondant pas aux normes du droit de la jeunesse. Les revendications formul\u00e9es ci-dessous constituent des mesures minimales \u00e0 prendre pour prot\u00e9ger les enfants d\u00e9tenus dans le syst\u00e8me isra\u00e9lien de d\u00e9tention militaire et pour combattre toutes les pratiques de torture et de maltraitance.<\/p>\n

 <\/p>\n

Revendications pour le respect des droits universels de l\u2019enfant emprisonn\u00e9: <\/strong><\/p>\n

 <\/p>\n

1. Les enfants ne peuvent pas \u00eatre arr\u00eat\u00e9s sauf dans des circonstances exceptionnelles et inhabituelles.<\/p>\n

 <\/p>\n

2. L\u2019utilisation de bandeaux sur les yeux et de menottes simples en plastic doit \u00eatre interdite dans tous les cas. En outre, l\u2019application de cette r\u00e8gle doit \u00eatre effective.<\/p>\n

 <\/p>\n

3. Tout enfant \u00e0 droit \u00e0 la pr\u00e9sence d\u2019un parent ou d\u2019un avocat de son choix avant et de pr\u00e9f\u00e9rence \u00e9galement durant l\u2019interrogatoire.<\/p>\n

 <\/p>\n

4. Chaque interrogatoire doit \u00eatre fix\u00e9e de mani\u00e8re audiovisuelle; une copie de l\u2019enregistrement doit \u00eatre fournie au repr\u00e9sentant l\u00e9gal de l\u2019enfant \u00e0 la fin de l\u2019interrogatoire.<\/p>\n

 <\/p>\n

5. Lorsqu\u2019un enfant n\u2019est pas inform\u00e9 au pr\u00e9alable de son droit au silence, l\u2019aveu obtenu par la cour militaire doit \u00eatre d\u00e9clar\u00e9 nul. Cela vaut \u00e9galement pour un aveu obtenu \u00e0 la suite de maltraitance ou de torture.<\/p>\n

 <\/p>\n

6. La d\u00e9tention en isolement et la d\u00e9tention administrative de mineurs d\u2019\u00e2ge dans les prisons isra\u00e9liennes doivent cesser imm\u00e9diatement et leur interdiction doit \u00eatre fix\u00e9e par la loi.<\/p>\n

7. Des m\u00e9canismes de contr\u00f4le fiables doivent \u00eatre instaur\u00e9s afin que toutes les plaintes de maltraitance soient examin\u00e9es et que les coupables soient punis.<\/p>\n

GEVANGENSCHAP IS GEEN KINDERSPEL<\/strong><\/p>\n

 <\/p>\n

Een arrestatie is op elke leeftijd een beklemmende ervaring, maar vooral kinderen houden er trauma\u2019s aan over.<\/p>\n

 <\/p>\n

In twee recent verschenen rapporten \u2013 tot stand gekomen met de financi\u00eble hulp van de Europese Unie<\/em> en gepubliceerd door Defence for Children International<\/em> (DCI) en de Isra\u00eblische mensenrechtenorganisatie Betselem<\/em> (*) \u2013 wordt in detail beschreven hoe Palestijnse minderjarigen geen eerlijke juridische bescherming genieten binnen het Isra\u00eblische militaire rechtssysteem.<\/p>\n

 <\/p>\n

Een aantal specifieke kinderrechten zoals contact met de ouders, bijstand door een advocaat tijdens de ondervraging en recht op bezoek en op onderwijs, worden aan Palestijnse kinderen in de Bezette Palestijnse Gebieden ontzegd. Dit na een arrestatie die meestal in het midden van de nacht gebeurt, vaak gepaard gaat met verbaal en fysiek geweld waarna de kinderen geboeid en geblinddoekt worden afgevoerd. De aanklachten zijn overwegend gebaseerd op vermoedens en worden nagenoeg nooit bewezen. Na urenlange ondervragingen of opsluitingen in een isoleercel, intimidatie d.m.v. dreigementen, wordt een bekentenis afgedwongen.<\/p>\n

 <\/p>\n

Sinds 2000 zijn in totaal 7500 Palestijnse kinderen op deze manier gearresteerd en berecht waarvan 975 jonger dan 15 jaar. Elke maand zitten er naar schatting 265 minderjarigen in de gevangenis.<\/p>\n

 <\/p>\n

Ik geloof in een rechtvaardige rechtsgang waarbij de Universele <\/em>Rechten van de mens<\/em> \u2013 en in dit dossier De Universele rechten van het Kind<\/em> in het bijzonder \u2013 gerespecteerd worden. De petitie wil ook de gemeenschap de ogen openen voor de discriminatie van de Palestijnse kinderen, alsmede voor de disproportie tussen aanklacht en straf in de Isra\u00eblische militaire rechtbanken.<\/p>\n

 <\/p>\n

Daarom onderteken ik de campagne van \u2018Palestina Solidariteit vzw\u2019 met de volgende eisen:<\/p>\n

 <\/p>\n

Geen enkel kind zou vervolgd mogen worden in militaire rechtbanken die geen eerlijke processen voeren en niet voldoen aan de normen van het Jeugdrecht. De onderstaande eisen zijn dan ook de minimale maatregelen die getroffen dienen te worden om de kinderen te beschermen die vastgehouden worden door het Isra\u00eblische militaire detentiesysteem en om alle praktijken van marteling en mishandeling tegen te gaan.<\/p>\n

 <\/p>\n

Eisen om respect en naleving van de Universele rechten van het Kind in gevangenschap. <\/strong><\/p>\n

 <\/p>\n

    \n
  1. Tenzij in uitzonderlijke en ongewone omstandigheden mogen kinderen enkel overdag gearresteerd worden.<\/li>\n
  2. In alle gevallen moet het gebruik van blinddoeken en enkelvoudige plastic handboeien verboden worden, daarenboven moet de navolging van deze regel daadwerkelijk opgevolgd worden.<\/li>\n
  3. Elk kind heeft recht op de aanwezigheid van een ouder en een advocaat van zijn\/haar keuze voorafgaand aan en bij voorkeur ook tijdens de duur van de ondervraging.<\/li>\n
  4. Elke ondervraging moet audiovisueel vastgelegd worden; een kopij van de opname moet daarenboven op het einde van de ondervraging bezorgd worden aan de wettelijke vertegenwoordiger van het kind.<\/li>\n
  5. Indien een kind vooraf niet gewezen werd op haar\/zijn recht op zwijgen, moet de bekentenis door het militair hof nietig verklaard worden. Dit geldt eveneens voor een bekentenis na mishandeling of marteling.<\/li>\n
  6. Eenzame opsluiting en administratieve aanhouding van minderjarigen in Isra\u00eblische gevangenissen moeten onmiddellijk gestopt worden en het verbod ervan moet bij wet vastgelegd worden.<\/li>\n
  7. Betrouwbare controlemechanismen moeten in voege treden opdat alle klachten van mishandeling onderzocht worden en de schuldigen bestraft worden.U kan deze petitie ondertekenen als organisatie door een e-mail te sturen naar secretariaat@palestinasolidariteit.be<\/li>\n<\/ol>\n

    CAPTIVITY IS NO CHILD\u2019S PLAY
    \nAn arrest is an oppressive experience at any age, but especially children are left with traumas.<\/p>\n

    In two recently published reports \u2013 worked out with the financial assistance of the European Union and published by Defence for Children International (DCI) and the Israeli Betselem human rights organisation (*) \u2013 is described in detail how Palestinian minors receive no fair legal protection within the Israeli military legal system.<\/p>\n

    A number of specific children\u2019s rights, such as contact with the parents, assistance by a lawyer during the interrogation and the right to visits and to education, are denied to Palestinian children in the occupied Palestinian territories. This occurs after an arrest which usually happens in the middle of the night, often accompanied by verbal and physical violence after which the children are blindfolded, handcuffed and hauled away. The charges are predominantly based on suspicions and are almost never proved. After hours of interrogations or detentions in solitary confinement, intimidation through threats, a confession is enforced.<\/p>\n

    Since 2000 a total of 7500 Palestinian children have been arrested and tried in this way of which 975 younger than 15 years. Each month an estimated number of 265 minors are in prison.<\/p>\n

    I believe in a fair judicial process where the universal human rights \u2013 and in this case the universal rights of the child in particular \u2013 are respected. I also want to open the eyes of the community for the discrimination of the Palestinian children, as well as for the imbalance between charge and punishment in Israeli military courts.<\/p>\n

    Therefore I sign the Campaign of \u2018Palestina Solidariteit vzw\u2019 with the following requirements:<\/p>\n

    No child should be prosecuted in military courts that offer them no fair trials meeting the standards of youth legislation. The requirements below are therefore the minimum measures that must be taken to protect children who are detained by the Israeli military detention system and to counteract all practices of torture and ill treatment.<\/p>\n

    Demands about respect and observation of the universal rights of the child in captivity:<\/p>\n

    1. Unless exceptional and unusual circumstances children may be arrested during the day only.
    \n2. In all cases, the use of blindfolds and of single plastic handcuffs has to be banned; in addition, the implementation of this rule must actually be controlled.
    \n3. Each child has the right to the presence of a parent and a lawyer of his\/her choice prior to and preferably also during the duration of the interrogation.
    \n4. Each interrogation should be captured audiovisually; in addition, a copy of the recording must be delivered to the legal representative of the child at the end of the interrogation.
    \n5. If a child has not previously been pointed to her\/his right to remain silent, the confession must be annulled by the military court. This also applies to a confession after mistreatment or torture.
    \n6. Solitary confinement and administrative detention of minors in Israeli jails must be stopped immediately and law should establish the ban.
    \n7. Reliable control mechanisms must be installed to ensure that all complaints of ill treatment are investigated and the culprits punished.<\/p>\n
